Data Protection Rights

What data protection rights do you have as a data subject?

As a data subject, you have the following rights at all times:

  • Access, rectification, erasure or restriction of the processing of your stored data (after uniquely identifying yourself with a valid identity document).
  • The right to object to the processing and use of your data for direct marketing purposes.
  • The right to data portability as required under data protection law.

Right to confirmation

After uniquely identifying yourself with a valid ID, you as the data subject have the right to request a confirmation from us as to whether we are processing personal data concerning you. You can contact us on this matter at any time by sending an e-mail to info@waldviertel.at.

Right of access

After uniquely identifying yourself with a valid ID, you as the data subject have the right at any time to access the stored personal data concerning you free of charge and to obtain a copy of that personal data. Your right of access covers the following information:

  • the purposes of the processing;
  • the categories of personal data that we are processing;
  • the recipients or categories of recipient to whom the personal data has been or will be disclosed; 
  • where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;
  • the existence of your right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning you or to object to such processing;
  • the existence of a right to lodge a complaint with the Austrian Data Protection Authority as supervisory authority;
  • provided your personal data is not collected from you as the data subject: any available information as to their source;

As part of operating our website, we contract software service providers and agencies that may obtain access to your personal data in the performance of their activities. These parties have pledged to us that they will adhere to the valid provisions of data protection law. Furthermore, as the data subject, you have the right to be informed whether your personal data has been transferred to a third country or to an international organization.  If this is the case, you as the data subject have the right to be informed of the appropriate safeguards relating to the transfer.

Right to rectification

After uniquely identifying yourself with a valid ID, you as the data subject have the right to obtain from us the rectification of inaccurate personal data concerning you without undue delay. You can contact us on this matter at any time by sending an e-mail to info@waldviertel.at.

Right to erasure (right to be forgotten)

After uniquely identifying yourself with a valid ID, you as the data subject have the right to the erasure of personal data concerning you without undue delay provided that one of the following grounds applies and that processing is not necessary:

  • Your personal data is no longer necessary for the purposes for which it was collected or otherwise processed.
  • As the data subject, you withdraw your consent on which the processing is based pursuant to point a of Article 6(1) GDPR or point a of Article 9(2) GDPR and there is no other legal grounds for the processing.
  • As the data subject, you object to the processing pursuant to Article 21(1) GDPR and there are no overriding legitimate grounds for the processing, or as the data subject, you object to the processing pursuant to Article 21(2) GDPR.
  • Your personal data has been unlawfully processed.
  • Your personal data has to be erased to comply with a legal obligation in Union law or the law of the Republic of Austria to which we are subject in our capacity as controller.

If one of the above grounds applies and you, as the data subject whose personal data is stored with Destination Waldviertel GmbH, wishes to have the data erased, you can contact us on this matter at any time at info@waldviertel.at.

Right to restriction of processing

After uniquely identifying yourself with a valid ID, you, as the data subject affected by the processing of your personal data, have the right to obtain from us as controller the restriction of processing where one of the following applies:

  • The accuracy of your personal data is contested by you as the data subject, namely for a period enabling us as the controller to verify the accuracy of your personal data.
  • The processing is unlawful and you as data subject oppose the erasure of your personal data and request the restriction of their use instead.
  • We as controller no longer need your personal data for the purposes of processing, but you as data subject need the data for the establishment, exercise or defense of legal claims.
  • you as data subject have objected to processing pursuant to Article 21(1) GDPR pending verification of whether the legitimate grounds of the controller override those of the data subject.

If one of the above grounds applies and you, as the data subject whose personal data is stored with Destination Waldviertel GmbH, wish to have the processing of the data restricted, you can contact us on this matter at any time at info@waldviertel.at.

Right to data portability

As the data subject affected by the processing of personal data, you have the right to receive the personal data concerning you, which you as data subject have provided in a structured, commonly used and machine-readable format to us as controller. You also have the right to transmit this data to another controller unhindered by us, where the processing is based on consent pursuant to point a of Art. 6(1) GDPR or point a of Art. 9(2) GDPR or on a contract pursuant to point b of Art. 6(1) GDPR and the processing is carried out by automated means unless processing is necessary for the execution of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Further, in exercising your right to data portability pursuant to Art. 20(1) GDPR, you as the data subject have the right to have the personal data transmitted directly by us as the controller to another controller, where technically feasible and where the rights and freedoms of others are not adversely affected.

Right to object

As the data subject, you have the right to object at any time, on grounds relating to your particular situation, to processing of personal data concerning you which is based on point e or f of Article 6(1) GDPR. You can e-mail us on this matter any time at info@waldviertel.at.

If we process your personal data for direct marketing purposes, you as data subject have the right at any time to object to the processing of the personal data for such marketing.
